Custom Supplement Development: Deliverables and Formula Rights
A concept discussion, a bench formula, an approved sample and a manufacturing specification are different outputs, with different evidence and commercial responsibilities.
Define the development deliverables and rights
| Decision | Information to request | How to use the answer |
|---|---|---|
| Feasibility review | Input brief, constraints and unresolved questions | Record whether the proposed route can be investigated, not a guaranteed result. |
| Prototype work | Sample codes, formula revisions and comparison criteria | Specify the decisions the samples must support. |
| Technical file | Composition, material references and applicable methods | Identify which records will be provided and in what form. |
| Ownership | Formula rights, confidentiality and permitted use | Separate access to a recipe from exclusive ownership. |
| Transfer | Manufacturing instructions, change control and remaining work | State what is required before routine production. |
Define what the brand receives at the development handover
Illustrative purchasing exercise, not a customer case, test result or quotation.
A sample is accepted, but the brand later asks another operator to make the product. Without a defined handover, possession of the sample does not establish access to the complete formula, process or manufacturing rights.
- Deliverables: List the recipe version, sample record and documents included in the fee.
- Rights: State access, use, transfer and confidentiality terms for the developed work.
- Next stage: Identify which further process or scale-up work a production proposal still requires.
Decision output: Agree these items before treating a formulation fee as ownership of an unrestricted production package. Record exclusions as clearly as included deliverables.
Agree how revisions are requested, evaluated and accepted. Include who pays for additional iterations and what happens if a target cannot be achieved. Formula ownership and transfer rights depend on the actual agreement; this checklist is not a substitute contract. Use the product specification to connect development outputs to later quality and manufacturing decisions.
