Private Label Supplements for the US Market: Define Import Responsibilities
Distinguish the overseas manufacturing operation, the importing arrangement and the company marketing the finished product.
Assign the US-project questions before shipment
| Decision | Information to request | How to use the answer |
|---|---|---|
| Product | Formula, ingredient status, serving and draft claims | Assign a reviewer for the actual product classification and label. |
| Manufacturing | Site and operations performed, including subcontracting | Identify which quality records will be available. |
| Import arrangement | Named parties and their regulatory and logistics roles | Have the responsible adviser determine applicable importer obligations. |
| Shipment | Batch references, documents and delivery terms | Confirm who resolves a document discrepancy or delayed entry. |
Build a shipment responsibility handover
Illustrative purchasing exercise, not a customer case, test result or quotation.
Before a US-bound order is released, connect the named product, manufacturing operation and importing arrangement. A supplier’s facility document and the importer’s obligations are different records; one should not be used as a substitute for the other.
- Product record: Controlled composition, proposed label and the party reviewing the actual classification.
- Shipment record: Batch reference, packing information and agreed delivery terms.
- Responsibility record: Named parties to resolve a missing document or an entry question.
Decision output: Ask the responsible regulatory adviser to determine the applicable obligations for that arrangement. Do not translate a prior successful shipment into a promise of admission for a new product.
Keep a responsibility matrix with the order. FDA describes modified FSVP requirements for certain dietary-supplement situations; applicability depends on the actual arrangement. Do not assume that every supplement shipment has the same exemption. A facility registration or a successful earlier shipment is not finished-product approval or a guarantee of future admission.
